1. Who we are
Sailing Dreams Charters S.L. (“Sailing Dreams”, “we”, “us”), CIF B-63439509, with registered office at [registered address], Marina Port Vell, 08039 Barcelona, Spain, is the data controller responsible for the personal data collected through www.sailingdreams.com (the “Site”) and in the course of arranging yacht charters. You can contact us about privacy at info@sailingdreams.com or on +34 628 122 278.
This policy is issued in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).
2. What data we collect
We collect only the data we need to answer your enquiry, arrange your charter and operate the Site:
- Enquiry and booking data — name, email address, telephone number, preferred dates, destination, number of people, charter style, sailing experience and anything you write in the message field.
- Charter contract data — once you book: passport or ID details of the charterer and, where required, of the crew and guests; sailing licence details for bareboat charters; billing address; payment details (processed by our payment provider, not stored by us); emergency contact.
- Correspondence — emails, WhatsApp messages and call notes exchanged with you.
- Technical data — IP address, browser type and pages visited, in server logs kept by our hosting provider for security and performance. We do not use analytics or advertising cookies (see the Cookie Policy).
We do not knowingly collect data from children under 14 except as guests named on a charter contract by a parent or guardian.
3. Why we use it and on what legal basis
| Purpose | Legal basis (GDPR art. 6) |
|---|---|
| Answering your enquiry and preparing charter proposals | Steps prior to a contract at your request (art. 6.1.b) |
| Arranging, performing and administering your charter, including sharing your details with the yacht operator, skipper and crew | Performance of a contract (art. 6.1.b) |
| Verifying sailing qualifications for bareboat charters; safety and crew lists required by port and maritime authorities | Legal obligation (art. 6.1.c) and contract |
| Invoicing, accounting and tax records | Legal obligation (art. 6.1.c) |
| Sending you occasional news about our charters and destinations | Consent (art. 6.1.a) — only if you opt in; you can withdraw at any time |
| Keeping the Site secure and preventing abuse | Legitimate interest (art. 6.1.f) |
| Establishing, exercising or defending legal claims | Legitimate interest (art. 6.1.f) |
4. Who we share it with
The yachts we offer are made available through the Booking Manager charter platform (MMK Systems d.o.o., Croatia) and are owned and operated by independent charter operators. To check availability, place an option and confirm a booking we necessarily share your name, contact details, dates and party details with the platform and with the operator of the yacht you charter, who becomes an independent data controller for the performance of the charter itself. Where a skipper, chef or hostess is engaged, they receive the details they need to look after you.
We also use service providers who process data on our behalf under contract: our website host (Netlify, Inc., USA), our email provider (Google Ireland Ltd), our payment provider [payment provider] and our accountants. Google Fonts are loaded from Google’s servers when you visit the Site, which transmits your IP address to Google Ireland Ltd.
Some providers are located outside the European Economic Area, notably in the United States. Where that is the case, transfers are made under the EU–US Data Privacy Framework or the European Commission’s Standard Contractual Clauses. We do not sell personal data.
5. How long we keep it
- Enquiries that do not lead to a booking: 24 months from our last contact, then deleted.
- Charter contracts, invoices and related correspondence: for the period required by Spanish tax and commercial law (generally 6 years from the end of the relationship), then deleted or anonymised.
- Marketing consent: until you withdraw it.
- Server logs: up to 30 days.
6. Your rights
You have the right to access your data, to have it rectified or erased, to restrict or object to its processing, to data portability, and to withdraw consent at any time without affecting processing already carried out. To exercise any of these rights, email info@sailingdreams.com with a copy of your ID; we respond within one month.
If you believe we have not handled your data properly, you may complain to the Spanish Data Protection Authority: Agencia Española de Protección de Datos, C/ Jorge Juan 6, 28001 Madrid, www.aepd.es.
7. Security
The Site is served over HTTPS. Access to enquiry and booking data is restricted to the people who need it, and our providers are contractually bound to keep it secure. No system is perfectly secure; if a breach affecting your data occurred we would inform you and the AEPD as the law requires.
8. Changes
We may update this policy from time to time; the date at the top shows the current version. Material changes will be flagged on the Site.
